Herman said she “was never a victim of sexual harassment or sexual abuse at the hands of Tiger Woods” in the new filing

Tiger Woods’ ex-girlfriend Erica Herman has dropped her appeal and sexual assault allegations against the golfer, PEOPLE can confirm.
According to new court documents from Florida’s Fourth District Court of Appeal obtained and reviewed by PEOPLE, Herman, 38, filed an official notice to dismiss her appeal, which initially intended to nullify a Non-Disclosure Agreement she signed in 2017 at the start of their relationship.
A judge had ruled in May that Herman could not be released from her NDA, leading Woods’ ex-girlfriend to file the appeal.
Herman’s initial lawsuit had cited the Speak Out Act, which allows an exception to NDAs for victims of sexual assault.
However, Herman claims now that she never accused Woods, 38, of any sexual assault. In Herman’s new filing on Friday, she stated that she “was never a victim of sexual harassment or sexual abuse at the hands of Tiger Woods or any of his agents and it is her position that she never asserted a claim for such.”
The appeal was dismissed by order of the court on Tuesday.

Herman had first filed a lawsuit in December, claiming she is owed $30 million because Woods kicked her out of his house before the terms of their “oral agreement” allowing her to live there for another five years came to an end.
And on March 6, she filed a separate complaint requesting to be let out of her non-disclosure agreement, citing a law that allows NDAs to be nullified in cases of sexual assault.
Herman’s initial complaint stated that Woods and Herman “had a long relationship” that was both professional and personal. Herman claimed she was “currently unsure what other information about her own life she may discuss or with whom,” the complaint stated.
In a filing by Woods’ attorneys disputing Herman’s claims, the golfer’s lawyer said, “Ms. Herman’s position is utterly meritless. It is a transparent abuse of the judicial process that undermines the purpose of the federal statute and those whom the statute seeks to protect.”
Herman dropped the $30 million lawsuit over her alleged eviction in July.

The filing noted that Herman signed the NDA in 2017, binding her to settle disputes privately, “as consideration for” the opportunity “to continue to spend time with Mr. Woods.”
Woods’ attorneys said, “For more than six years, Ms. Herman enjoyed the benefits of her agreement,” in the court documents, alleging that his ex-girlfriend is “making salacious and insidious implications” of claims relating to sexual assault disputes.
Herman, a former restaurant manager, was first romantically linked to Woods when she was pictured alongside him at the Presidents Cup in new Jersey in September 2017. It was there at the tournament — where Woods served as an assistant captain for the United States team — that Herman wore a badge reserved for the girlfriends and wives of players.
Over the years, Herman had been a constant at the course whenever Woods is competing. However, the couple had otherwise remained very private over the years (a notable difference from Woods’ previous relationship with Lindsey Vonn and his very public marriage and divorce from Elin Nordegren).
They were rarely seen out in public at non-golf events, but they did attend the 2022 US Open together to support Serena Williams from the stands.
“No one has signed any paperwork,” a friend of Woods told PEOPLE in 2018 about the couple. “It’s not like they’re pledging their lives to each other. But she’s really nice and Tiger likes her.”
“Tiger doesn’t like to be alone,” the friend added. “But he doesn’t like to settle. Not anymore. So when he’s with someone, he really needs to be into her.”
